Farris litigators Ludmila Herbst, Q.C. and Catherine George presented on November 18, 2016 at a Continuing Legal Education Society of B.C. (“CLE”) conference on Business Disputes. Ludmila and Catherine are co-authors of a chapter in the award-winning CLE text of the same title. They presented on new developments related to misrepresentation-related causes of action in tort, contract and by statute. Catherine dealt primarily with the role of statutory misrepresentation claims in the class action context, and Ludmila addressed the repercussions of the Supreme Court of Canada’s decision in Bhasin v. Hrynew, 2014 SCC 71, establishing a duty of honest performance of contractual obligations which overlaps with certain existing misrepresentation claims.
