In response to a constitutional challenge brought by Farris litigators, the BC Supreme Court in Kaps v. Surrey (City) 2022 BCSC 1191 has ordered the City of Surrey to re-write one of its bylaws on the basis that it unjustifiably infringes the right to freedom of expression protected under the Canadian Charter of Rights and Freedoms. Partner, Kevin Smith and Associate, Catherine George represented six members of the “Keep the RCMP in Surrey” Campaign who took aim at amendments to a municipal bylaw which unlawfully prohibited signs promoting “political issues” generally. The case has the potential to be of significance to local advocacy groups and campaigners more broadly and has generated significant public interest.
